Brinco - BEAST Application

These Terms of Use govern access to and use of the BEAST Application.

1. Acceptance and scope

Brinco Mechanical Management Services, Inc. (“Brinco,” “we,” “us” or “our”) provides the BEAST Application to authorized users of the BRINCO service. By downloading, accessing or using the BEAST Application, you agree to these Terms. The BEAST Application Privacy Policy explains how personal information is handled.

If you use the BEAST Application through your employer or another organization, that organization controls your account, the work information available to you and your permitted use of the service. The agreement between Brinco and your organization governs the service provided to that organization and prevails over these Terms where the two conflict.

2. Eligibility and accounts

The BEAST Application is for users who have received an account from their organization. Keep your credentials confidential. If you suspect unauthorized access, notify your organization’s BRINCO administrator and Brinco at support@brinco.com or 800-649-6804.

Do not share your account, use another person’s account or attempt to access information that has not been made available to you.

3. License to use the app

Subject to these Terms, Brinco grants you a limited, personal, non-exclusive, non-transferable license to use the BEAST Application solely for your organization’s authorized work purposes. This license ends as described in section 9.

You may not copy, modify, distribute, sell, rent, lease, sublicense, reverse engineer, decompile or attempt to extract source code from the app except where applicable law or an open-source license gives you that right.

4. Acceptable use

You must not use the BEAST Application to:

• break the law or infringe another person’s rights;
• upload malware or harmful code;
• interfere with the app, its backend services, security controls or other users;
• bypass authentication, permissions or technical restrictions;
• use the app for advertising, unauthorized data collection or any purpose outside your organization’s authorized work; or
• submit photos, documents or other information unless you have the right to use and share them for the relevant work purpose.

5. Work information and content

You are responsible for content that you submit through the BEAST Application and for having authority to submit it. Your organization is responsible for other work information that it makes available through the service.

Brinco processes work information to operate, synchronize, support and secure the BEAST Application under its agreement with your organization.

6. Offline use and synchronization

The BEAST Application stores relevant work information on your device to support offline use. Changes are queued on the device. When Auto Sync is enabled, the app attempts to send queued changes when a network connection is available; you can also start a manual sync. Confirm that important work shows as successfully synchronized before relying on it as complete.

Do not use the BEAST Application for emergency communications or safety-critical activities that require guaranteed real-time delivery.

7. Availability, updates and support

Brinco may update or maintain the BEAST Application to improve the service, address security issues or comply with legal obligations, subject to its agreement with your organization. Support is provided under that agreement. For support, contact your organization’s BRINCO administrator.

8. Intellectual property

The BEAST Application, including its software, design, trademarks and documentation, is owned by or licensed to Brinco and is protected by applicable intellectual-property laws. These Terms do not transfer ownership of the app or its intellectual property to you.

9. Suspension and termination

Your organization may revoke your access, including when your employment or engagement ends. Brinco may suspend or terminate access as permitted by its agreement with your organization or when reasonably necessary to protect the service, users or legal rights.

When access ends, stop using the app. Cached records and queued changes can remain on the device until the app is removed or its app storage is erased, as described in the Privacy Policy. Sections 4, 5, 8, 9 and 10 continue after access ends.

10. Disclaimers and liability

The BEAST Application is provided on an “as is” and “as available” basis to the maximum extent permitted by applicable law. Brinco does not guarantee that the app will be uninterrupted, error-free or suitable for a particular purpose.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited. Any additional warranties, indemnities, liability limitations and remedies are governed by the agreement between Brinco and your organization.

11. Changes to these Terms

Brinco may update these Terms when the service, legal requirements or business practices change. The current version will be published on this page with an updated effective date. Any notice or acceptance required by law or the agreement with your organization will be obtained before a material change takes effect.

12. Governing terms and contact

The law, venue and dispute procedure in the agreement between Brinco and your organization govern the use of the BEAST Application by that organization’s authorized users. For questions about these Terms, contact Brinco at support@brinco.com or 800-649-6804.
